The Long Arm of Judicial Corruption:
Problems with Rule of Law in Latin America and the
Emergence of a New Threat to Corporate Assets in the United States
A new threat to U.S. corporate assets may be brewing
abroad. As illustrated by one recent case arising out of Nicaragua,
corruption and political influence can turn a nation's courts into virtual
engines of liability, converting fraudulent claims into massive default
judgments against U.S. corporations. When plaintiffs' attorneys in the
United States import these judgments, suing to enforce them against domestic
corporate assets, the named defendants can face potentially ruinous exposure.
Join a panel of experts as they discuss the ways in which recent problems
with rule of law in Latin America are having a very real impact on U.S.
businesses. The panelists will explore the implications of weak judicial
systems for numerous issues that arise in transnational litigation,
including enforcement of foreign judgments and the doctrine of forum non
conveniens. The program will also discuss efforts to strengthen rule of law
in Latin America, as well as steps that U.S. businesses can take in the
meantime to protect themselves from the long arm of judicial corruption.
